New York v. Pruitt

ELR Citation: 48 ELR 20095
Nos. 18-cv-406, (S.D.N.Y., 06/12/2018) (Koeltl, J.)

A district court ordered EPA to issue federal implementation plans fully resolving interstate transport obligations under the CAA's "good neighbor" provision for the 2008 ozone NAAQS. EPA conceded that it missed the deadline to do so under the Act. The Agency also acknowledged that it was feasible to issue a proposal by June 29, 2018, and to promulgate a final rule by December 6, 2018. The court therefore granted summary judgment in favor of Connecticut and New York, the two states downwind from the defaulting states.
