Puget Soundkeeper Alliance v. Ranier Petroleum Corp.

A district court, on motions for summary judgment, held that a marine fueling, service, and storage facility in Seattle was liable under the CWA for various NPDES general permit violations. The company's stormwater discharges exceeded the benchmarks for zinc and copper, the company failed to monitor discharges at several of its discharge points, and it conceded its failure to submit annual reports for 2013 and 2014. The company also failed to conduct and properly document monthly inspections of the facility and failed to take corrective action for certain discharges. But there were issues of fact that precluded the grant of summary judgment on some of the claims, including those pertaining to alleged water quality standard violations and stormwater pollution prevention plan deficiencies.
