Gunpowder Riverkeeper v. Federal Energy Regulatory Comm'n

The D.C. Circuit denied an environmental group's petition for review challenging FERC's decision to issue a natural gas pipeline operator a certificate of public convenience and necessity to extend a natural gas pipeline in Maryland. The group argued that FERC's issuance of the conditional certificate of public convenience and necessity violated both the CWA and NEPA. But the group only alleged that some of its members "are subject to actual or the threat of eminent domain proceedings now that will result in a loss of property rights." Because it failed to allege its members would suffer any environmental harm, its NEPA and CWA claims fall outside the zone of interests of either statute.
