A New York court dismissed mineral rights owners' lawsuit seeking to compel the state to finalize its supplemental EIS on hydraulic fracturing. The owners filed the lawsuit under the State Environmental Quality Review Act (SEQRA), claiming that the state's failure to finalize the standards for high-volume hydraulic fracturing is preventing them from realizing royalties or other development of their oil and gas estates. But the owners lack standing because they failed to allege any environmental harm. Rather, their injuries are purely economic, which lay outside the zone of interests governed by the SEQRA.
