A California appellate court affirmed a lower court decision that the California Fish & Game Commission erred in rejecting a petition to add the California tiger salamander to the list of endangered species under the California Endangered Species Act. The administrative record shows the salamander species does not breed prolifically, is vulnerable to several significant threats, has lost most of its original habitat, and has been displaced by a hybrid from a significant portion of its range. This information indicates that some listing action may be warranted. The Commission therefore acted outside the range of its discretion in denying the petition.
