Muzzy Ranch Co. v. Solano County Airport Land Use Comm'n

A California appellate court upheld the dismissal of a landowner's claims that an airport land use compatibility plan for the Travis Air Force Base is not consistent with an Air Force installation compatible use zone study prepared for the site. A landowner argued that the safety and noise standards used in the land use compatibility plan must be identical to those in the compatible use zone study. The standards in the plan, however, need only be compatible with those in the study. Under the facts of this case, compatibility means that the land use plan must be at least as protective of airport operations as the applicable compatible use zone study. It need not literally adopt the safety and noise standards in the study.
