Communities for a Better Env't v. EPA

A district court ordered the U.S. Environmental Protection Agency (EPA) to review and, if necessary, revise the national ambient air quality standards (NAAQS) for carbon monoxide (CO) by May 13, 2011. The parties agreed that EPA missed the Clean Air Act's deadline to review the CO standard but disagreed as to how much time EPA should be provided to comply with its statutory obligation. Because EPA failed to demonstrate that meeting the deadline would be "impossible," particularly since EPA has reviewed other pollutants in less time, the court ordered EPA to complete the NAAQS review and revision process by May 13, 2011.
