California Sportfishing Protection Alliance v. State Water Resources Control Bd.

A California appellate court affirmed a lower court decision upholding amendments to the Water Quality Control Plan for the Sacramento and San Joaquin River basin. Defendants presented sufficient evidence to demonstrate that Deer Creek does not support a viable population of rainbow trout and that the proposed temperature change for the creek is adequately protective of salmonids. The environmental impact report prepared for the basin plan complies with the applicable administrative regulations, Cal. Code Regs. tit. 23, §§3775-3782, which are the functional equivalent of the California Environmental Quality Act.
