Douda v. California Coastal Comm'n

ELR Citation: 38 ELR 20044
Nos. No. B188210, (Cal. App. 2d Dist., 02/06/2008)

A California appellate court upheld the California Coastal Commission's denial of a coastal development permit to build a home. The commission determined that the property contains an "environmentally sensitive habitat area" that had not been designated in the Los Angeles County land use plan and that the proposed development would impair scenic and visual resources. The court ruled that the commission was authorized to deny the permit based on these findings.
