Feldman v. Bomar

ELR Citation: 38 ELR 20009
Nos. No. 06-55475, (9th Cir., 01/10/2008)

The Ninth Circuit dismissed individuals' appeal from a judgment for defendants in a case claiming that they violated the National Environmental Policy Act and the California Environmental Quality Act in adopting a National Park Service (NPS) program to restore and protect Santa Cruz Island by, in part, eradicating its feral pig population. The NPS completely eradicated the feral pigs from the island during the pendency of the litigation, and the individuals alleged only procedural violations in the development of the eradication program and did not seek compensation in monetary damages. Because there is no longer a live controversy, the individuals' appeal was dismissed as moot.
