Broudy v. Mather

ELR Citation: 36 ELR 20177
Nos. No. 05-5085, (D.C. Cir., 08/23/2006)

The court upholds the dismissal of military veterans' claims that they were denied meaningful access to administrative proceedings before the Department of Veterans Affairs to pursue compensation for their alleged exposure to dangerous levels of atomic radiation while members of the U.S. armed forces. Because the veterans fail to show that no avenue exists through which they can meaningfully pursue their underlying benefits claims, they fail to state a claim for denial of access to the courts.
