Pacific Rivers Council v. Thomas
ELR Citation: 25 ELR 20809
Nos. No. 94-0159-S-DAE, 897 F. Supp. 454/(D. Idaho, 03/08/1995) Preliminary injunction dissolved
The court dissolves the injunction it issued on January 12, 1995, by which the court enjoined the U.S. Forest Service from funding, permitting, or announcing new, ongoing, or announced timber sales, range activities, mining activities, or road-building projects in six national forests in Idaho pending completion of formal consultation between the Forest Service and the National Marine Fisheries Service (NMFS) under the Endangered Species Act §7 on the effects of land and resource management plans on endangered salmon species. NMFS issued its formal biological opinion on March 1, 1995, thereby completing the formal consultation process between the Forest Service and NMFS.
