National Helium Corp. v. Morton

Secretary of the Interior's cancellation of contracts for the extraction and sale of helium to government that were awarded under National Helium Act, 50 U.S.C. §§167 et seq. are enjoined pending court review. The Secretary's exercise of discretionary authority under the National Helium Act, so as allegedly not to comply with that statute and the National Environmental Policy Act, 42 U.S.C. §§4321-4331 et seq., constitutes agency action subject to judicial review under the Administrative Procedure Act (APA), 5 U.S.C. §§551 et seq. Plaintiff has standing as a government contractor under the APA, 5 U.S.C. §702, and as a private attorney general, to question the validity of administrative action action that affects his contractual relationship with the government. Bond of $75,000 required as security against wrongful restraint of defendants.
