Natural Resources Defense Council v. NRC

The court rules that the Nuclear Regulatory Commission (NRC) may not allow site preparation activities for the Clinch River Breeder Reactor prior to issuance of a construction permit unless it finds that exigent circumstances warrant the exemption. Following a sua sponte reconsideration of the case, the court first withdraws its opinion and order of December 2, 1982. The court then holds that the NRC is bound by its prior interpretation of its regulations that exemptions are available only under exigent circumstances. It remands the record to the agency either to make a finding of emergency conditions or to proceed with an adjudicatory construction permit hearing.
