Vermont: Quality

The Vermont Department of Forests, Parks, and Recreation is proposing to amend Vt. Code R. 87-038 regarding logging practices. The amendments would establish water quality preservation practices to be implemented before, during, and immediately after logging activities. South Carolina: Waste

The South Carolina Department of Health and Environmental Control seeks to amend 1976 S.C. Code Ann. Regs. 61-107.279 regarding the management of used oil. The amendments would allow used oil fuel marketers to operate without a permit and identify the conditions under which used oil contaminated with PCBs is subject to RCRA regulation. A public hearing will be held on January 7, 2016. Written comments will be accepted until 5pm on December 29, 2015. See file:///C:/Users/waxman/Downloads/sr39-11.pdf (pp. 72-76).

South Carolina: Waste

The South Carolina Department of Health and Environmental Control seeks to amend 1976 S.C. Code Ann. Regs. 61-107.12 the South Carolina Solid Waste Policy and Management Act. The changes would establish standards for the management of facilities that incinerate solid waste. A public hearing will be held on January 7, 2016. Oregon: Land Use

The Oregon Department of State Lands proposes to amend Or. Admin. R. 183 regarding the identification of filled lands. The changes would distinguish between “historically filled lands” and “new lands” for purposes of determining ownership and transfer of ownership of property built on submerged and submergible lands. Public hearings will be held on December 16-17, 2015. Written comments will be accepted until 5pm on December 31, 2015.

Oregon: Public Lands

The Oregon Department of Forestry is proposing to amend Or. Admin. R. 629 regarding the use of state forest lands. The changes, which are intended to reduce conflicts between users, would amend the processes for obtaining a large commercial permit, provide health and safety standards, and clarify enforcement rules, among other changes. Public hearings will be held on December 17, 2015, and January 4 and 15, 2016. Written comments will be accepted until 5pm on February 8, 2016.

Oklahoma: Quality

The Oklahoma Water Resources Board is proposing to amend Okla. Admin. Code §785:45 regarding water quality standards. The changes would address classifications of waterbodies, designated beneficial uses of surface water and criteria to protect those uses, and modifications to designated management areas, among other issues. A public hearing will be held on January 19, 2015. Written comments will be accepted until the close of the public hearing.

New Mexico: Land Use

The New Mexico Energy, Minerals, and Natural Resources Department and the New Mexico Taxation and Revenue Department are proposing to amend N.M. Admin. Code tit. 3.13.20, the Land Conservation Incentives Tax Credit rule. The changes would address appraisal practices and revise certain definitions. A public hearing will be held on December 16, 2015. Montana: Air

The Montana Department of Environmental Quality is proposing to repeal Mont. Admin. R. 17.74.101-102 regarding occupational air contaminants and noise. The rules were authorized under the Occupational Health Act of Montana, which has been repealed. Written comments will be accepted until December 24, 1015. Florida: Air

The Florida Department of Environmental Protection is proposing to update Fla. Admin. Code Ann. r. 62-204.800 regarding air pollution regulations. The changes would adopt by reference federal regulations that are cited in the department’s air pollution rules, including procedures for submittal of implementation plans, standards for hazardous air pollutants, and performance standards for new stationary sources, among many other changes. Written comments will be accepted until December 23, 2015. No public hearing has been scheduled.

Alabama: Waste

The Alabama Department of Environmental Management is proposing revisions to Ala. Admin Code r. 335-13-4-.26 regarding the management of wood boiler ash waste. The department is proposing to establish monitoring, certification, recordkeeping, and reporting requirements for wood boil ash waste that has less than 50% of toxicity characteristic levels for metals not permitted in a landfill. A public hearing will be held on January 6, 2016. Written comments will be accepted until 5pm on January 6, 2016.
