Virginia: Water

The Virginia Water Control Board is proposing to amend 9 Va. Code Ann. §25-210 regarding the state’s water protection permit program. The proposed changes would revise the application process for permits and revise compensatory mitigation requirements, among other changes. Public hearings will be held on January 11-13, 2016. North Carolina: Air

The North Carolina Department of Environmental Quality seeks public input on N.C. Admin. Code tit. 15A, r. 02D, regarding performance standards for carbon dioxide emissions for existing electric utility generating units. The changes would classify fossil-fuel electric utility generating units as subject to regulation, identify best system of emissions reduction measures for carbon dioxide measures, establish permit requirements, and identify monitoring, recordkeeping, and reporting requirements. Public hearings will be held on December 16 and 17, 2015, and on January 5, 2016.

Michigan: Air

The Michigan Department of Environmental Quality is proposing changes to Mich. Admin. Code r. 336 regarding air pollution control. The changes would: (1) amend several definitions, including the limits on “significant rate of emissions” for several air contaminants; (2) rescind the section on limiting potential-to-emit by registration; and (3) amend the process and applicability for obtaining renewable operating permits. A public hearing will be held on December 7, 2015. Written comments will be accepted until December 18, 2015.

Maryland: Air

The Maryland Department of the Environment is proposing changes to Md. Regs. Code tit. 26.11.01 regarding the regulation of incinerators and cement plants. The changes would clarify requirements for plants demonstrating compliance with visible emissions standards and exempt incinerators that meet certain ownership or use requirements. A public hearing will be held on December 14, 2015. Written comments will be accepted until December 14, 2015. See http://www.dsd.state.md.us/MDR/4223.pdf (pp. 1465-68).

Maine: Waste

The Maine Department of Environmental Protection is proposing to amend Code Me. R. §415 regarding the handling and recycling of electronic waste. The changes would provide television and game console manufacturers credits for developing their own electronic waste recycling programs, update definitions, and ensure consistency with Maine’s Electronic Waste Law. Florida: Waste

The Florida Department of Environmental Protection is proposing to amend Fla. Admin. Code Ann. r. 62-701 regarding solid waste facilities. The amendments concern the processing of construction and demolition debris prior to disposal. A public hearing will be held on December 9, 2015.
