Utah: Quality

The Department of Environmental Quality is proposing to amend Utah Admin. Code r. 317-2-7(7.1) regarding water quality standards. Changes would provide that when the natural background concentration of a pollutant is higher than the applicable statewide water quality standard, the criterion will be the background concentration. The Department of Environmental Quality is proposing to amend Utah Admin. Code r. 309-510 regarding drinking water supplies. Among other changes, the amendment would clarify that local authorities can impose design criteria on drinking water systems, and regulate irrigation supplied by such systems. The Department of Environmental Quality is proposing to amend Utah Admin. Code r. 307-230 regarding nitrogen oxide emissions. Changes would establish a statewide implementation schedule by which ultra-low nitrogen oxide water heaters are required to be sold and installed throughout the state. The Department of Environmental Quality is proposing to amend Utah Admin. Code r. 307-122 regarding heavy duty vehicle tax credits. Changes would outline the process for qualifying for the heavy duty vehicle tax credit for the purchase of a natural gas heavy duty vehicle. The deadline for comment is July 1, 2015. The Department of Environmental Quality is proposing to amend Utah Admin. Code r. 307-121 regarding vehicle tax credits. Changes would add provisions to include electric motorcycles in the program. Utah: Clean Air Act (CAA)

The Department of Environmental Quality is proposing to amend Utah Admin. Code r. 307-101-3 regarding air emission definitions. Changes would incorporate by reference updated EPA regulations concerning definitions under the CAA. The deadline for comment is July 1, 2015. The Commission on Environmental Quality is proposing to adopt 30 Tex. Admin. Code §§ 317.1 through .13 and .15 regarding wastewater treatment systems. The new rules would eliminate any regulatory gaps created by the repeal of those sections in 2008 and the adoption of new regulations under 30 Tex. Admin. Code §217. The Commission on Environmental Quality is proposing to amend various portions of 30 Tex. Admin. Code §217 regarding wastewater treatment systems. The amendments would make non-substantial changes to the chapter to improve clarity and correct errors. A public hearing will be held June 23, 2015, and the deadline for comment is June 29, 2015. South Dakota: Watershed Protection

The Department of Environment and Natural Resources is proposing to amend S.D. Admin. R. 74:05:05:16 regarding watershed boundaries. Changes would make adjustments to the area of the James River Water Development District. A public hearing will be held June 25, 2015, and the deadline for written comment is June 24, 2015. South Carolina: Clean Water Act (CWA)

The Department of Health and Environmental Control is proposing to amend S.C. Code Ann. Regs. 61-50.C.7 and 61-50.D.6 regarding water quality in natural swimming areas. Changes would replace fecal coliform with E. Coli as the indicator of bacteriological water quality in new and existing natural swimming areas. A public hearing will be held August 13, 2015, and the deadline for written comments is June 22, 2015. See 39 S.C. Reg. p. 23 (May 22, 2015).
