Wisconsin: Toxic Substances

The Department of Natural Resources proposed to amend Wis. Admin. Code NR §446.3, pertaining to the control of mercury emissions from coal-fired electric generating units. Changes would extend the NR §446.3 compliance date from January 1, 2015 to April 16, 2016. A public hearing will be held on November 12, 2013, and the deadline for comment is November 14, 2013. Wisconsin: Mining

The Department of Natural Resources proposed to amend Wis. Admin. Code NR §130-132, NR §182, and NR §500-538, among others, in order to comply with the Ferrous Mining Law §103. Public hearings will be held on November 11 and November 15, 2013, and the deadline for comment is December 2, 2013. Washington: Air

The Department of Ecology proposed to amend Wash. Admin. Code §173.433, Solid Fuel Burning Devices. Changes seek to reduce Washington’s wood smoke emissions. Washington: Wildlife

The Noxious Weed Control Board proposed to amend Wash. Admin. Code §16.750. Changes pertain to the State Noxious Weed List, and include the addition of two Class B noxious weeds and two Class C noxious weeds and the reclassification of other noxious weeds. Virginia: Quality

The State Water Control Board amended 9 Va. Admin Code §C25.31, Virginia Pollutant Discharge Elimination System (VPDES) Permit Regulation. Changes reflect amendments to 40 CFR 122.23 and pertain to the VPDES permits required for concentrated animal feeding operations. See http://register.dls.virginia.gov/details.aspx?id=3970.

Texas: Natural Resources

The Texas Parks and Wildlife Commission amended 31 Texas Admin. Code §69.71, pertaining to a Memorandum of Understanding (MOU) between the Texas Parks and Wildlife Department (TPWD) and the Texas Department of Transportation (TxDOT). The MOU gives the TPWD authority to review TxDOT projects that have the potential to affect natural resources. Changes took effect on October 21, 2013. Tennessee: Endangered Species

The Environment and Conservation Agency amended Tenn. Admin. Code §0400.06.02, Rare Plant Protection and Conservation Regulations. Indiana: Waste

The Indiana State Department of Health proposed to amend 410 Ind. Admin. Code §6.8.3. Changes pertain to the definition of a residential sewer, sewage holding tank requirements, minimum separation distances, septic tank construction, outlet filters, and the removal of abandoned buried electric lines. New York: Wildlife

The Department of Environmental Conservation amended N.Y Comp. Codes R. & Regs. tit. 6, §40.1(f) and added §40.1(x) in order to establish commercial quota management and recreational regulations for Atlantic Menhaden.
