Louisiana: Clean Air Act (CAA)

The Department of Environmental Quality proposed to amend La. Admin. Code 33:III.905, Control Facilities to be Installed When Feasible. Changes will allow the department to grant an exemption to the owner or operator of a facility installed solely to comply with a proposed regulation that fails to be promulgated or a final regulation that is remanded. There will be a public hearing February 27, 2013, and the deadline for comment is March 6. See http://www.doa.la.gov/osr/reg/1301/1301.pdf (pp. 170-72).

Alaska: Fisheries

The Department of Fish and Game amended 5 Alaska Admin. Code 41, pertaining to aquatic farm and hatchery operation permit applications. Changes relate to geoduck stock transfer to management areas. Connecticut: Clean Air Act (CAA)

The Department of Energy and Environmental Protection proposed to adopt Conn. Agencies Regs. §22a.174.20, pertaining to the control of volatile organic compound emissions. Amendments would remove the option to use an undomed floating roof tank to store compounds and revise the leak control provisions for synthetic organic chemical and polymer manufacturing equipment, among other changes. There will be a public hearing March 7, 2013, and the deadline for comment is March 8.

District of Columbia: Energy

The Department of the Environment adopted 20 D.C. Municipal Regs. §35.13, Energy Performance Benchmarking of Privately Owned Buildings. The rule requires owners of privately owned buildings to annually benchmark their buildings using the ENERGY STAR Portfolio Manager benchmarking tool. The rule also requires owners to submit their benchmarking to the Department and requires the Department to make the results available to the public.

District of Columbia: Waste

The Department of the Environment amended 20 D.C. Mun. Regs. §43, Hazardous Waste Management Regulations Administration and Enforcement. The amendment changes the definition of "regulated medical waste." See http://www.dcregs.dc.gov/Gateway/NoticeHome.aspx?noticeid=4148319.
