New Hampshire: Hazardous Substances

The Department of Environmental Services proposed to amend Env-Or 300, Aboveground Petroleum Storage Facilities. The rulemaking would readopt the rules, scheduled to expire, and substantially reorganize the rules and make several changes. South Dakota: Waste

The Department of Environment and Natural Resources proposed to amend the state’s hazardous waste rules to incorporate changes to federal regulations. Changes establish procedures for identifying and managing certain hazardous secondary materials. There will be a public hearing August 15, 2013. Maine: Land Use

The Land Use Planning Commission proposed to amend 04-061 Code Me. Regs. Ch. 4, Rules of Practice. Changes would incorporate state laws giving the Commission the responsibility to issue certification determinations to the Department of Environmental Protection prior to the issuance of site location permits. Florida: Water

California: Toxic Substances

The Office of Environmental Health Hazard Assessment amended 27 Cal. Code Regs. §25902 to add clomiphene citrate to the list of chemicals known to cause cancer or reproductive toxicity. The listing took effect May 24, 2013. See http://www.oal.ca.gov/res/docs/pdf/notice/21z-2013.pdf (pp. 766-85).

Vermont: Water

North Dakota: Radiation

The Department of Health proposed to amend N.D. Admin. Code §33.10.04.2, Standard for Protection Against Radiation. Changes restore an appendix left out during the last rule amendment. Alaska: Clean Air Act (CAA)

The Department of Environmental Conservation proposed to amend 18 Alaska Admin. Code 50 pertaining to Air Quality Control. Changes adopt rules by reference and incorporate designation changes. California: Hazardous Substances

The Office of Spill Prevention and Response proposed to amend 14 Cal. Code Regs. §820.01, pertaining to drill and exercise requirements for oil spill contingency plans. Among other changes, the rulemaking would rewrite objectives to be more performance based and measurable. There will be public hearings July 9 & 11, 2013.
