Oregon: Forests

The Department of Forestry proposed to amend Or. Admin. R. 629.200, pertaining to written plans near streams and wetlands. Changes include general Forest Practices Act housekeeping edits. Oregon: Energy

The Department of Energy proposed to amend Or. Admin. R. 330.090 to allow the state to carry out its obligations to Business Energy Tax Credit program participants until 2014, when the program will end and be replaced by the Business Energy Incentives Program. New Hampshire: Wetlands

The Department of Environmental Services proposed to amend Env-Wt 200, Wetlands Rules of Practice and Procedure, and 300, 400, 500, 600, & 700, Wetland Program Rules. The rules pertain to procedures for hearings on permit applications, and the rulemaking will allow them to continue after their expiration on April 25. Tennessee: Waste

The Environment and Conservation Agency added Tenn. Admin. Code §0400.40.15, Biosolids Management, to promulgate rules for land application of biosolids. The rules are substantially similar to federal regulations, which the state has no authority to enforce. Rules take effect June 30, 2013. See http://www.tn.gov/sos/rules_filings/04-01-13.pdf.

North Carolina: Oceans

The Environmental Management Commission proposed to amend 15A N.C. Admin. Code 07H .0300, Ocean Hazard Areas. Changes would provide financial relief to applicants for permits for certain beach fill projects. There will be a public hearing May 5, 2013, and the deadline for comment is June 14. Kentucky: Water

The Energy and Environment Cabinet proposed to add 400 Ky. Admin. Regs. 5.320, Wastewater Laboratory Certification Program. There will be a public hearing April 25, 2013, and the deadline for comment is April 30. See http://www.lrc.state.ky.us/kar/401/005/320reg.htm.

Delaware: Clean Air Act (CAA)

The Department of Natural Resources and Environmental Control proposed to amend 7 Del. Admin. Code Ch. 60 §1108, Sulfur Dioxide Emissions From Fuel Burning Equipment. Changes would lower the allowable content of sulfur in combusted fuels for the purposes of NAAQS attainment. There will be a public hearing April 24, 2013. Clean Air Act (CAA)

Delaware: Quality

The Department of Natural Resources and Environmental Control proposed to amend 7 Del. Admin. Code Ch. 40 §5101, Sediment and Stormwater Regulations. Changes address 2005 recommendations of Governor Minner’s Task Force on Surface Water Management relating to stormwater volume management, conveyance adequacy, operation and maintenance of stormwater management facilities. There will be a public hearing April 23, 2013, and the deadline for comment is May 5.

Quality

Florida: Water

The Department of Environmental Protection proposed to amend 62 Fla. Admin. Code §4, Permits. Changes reduce the application fee for establishing a site specific alternative criterion in surface waters. The deadline for comment is April 22, 2013. Wisconsin: Environmental Law and Policy/Governance
