Kentucky: Clean Air Act (CAA)

The Energy and Environment Cabinet amended 400 Ky. Admin. Regs. 5, Attainment and Maintenance of the National Ambient Air Quality Standards. Changes alter section definitions. The amendment was approved October 9, 2012. See http://www.lrc.state.ky.us/kar/401/051/001reg.htm.

Oregon: Water

The Department of State Lands proposed to amend Or. Admin. R. 141.085, 141.089, & 141.093, Removal-Fill Authorizations within Oregon Waters, General Authorizations and General Permits. The amendments ensure consistency with 2011 legislation, adding additional activities and adjusting the fee schedule. Changes took effect September 29, 2012. Oregon: Energy

The Land Conservation and Development Department proposed to amend Or. Admin. R. 660.036 to implement recent changes to the Territorial Sea Plan. Amendments would designate areas and establish regulatory standards for marine renewable energy development within the territorial sea. Oregon: Wetlands

The Department of State Lands proposed to amend Or. Admin. R. 141.090 to implement recent state legislation. Amendments would allow landowners to request an independent review of a wetland delineation report when there is a disagreement with a department decision. In addition, the changes would allow landowners to request a five-year extension of a recently expired delineation. There will be a public hearing November 15, 2012, and the deadline for comment is November 30.

The Department of Energy proposed to amend Or. Admin. R. 330.070, Residential Energy Tax Credit. Amendments clarify cost terms, statutory incentive amounts, the year the tax credit can be claimed, and tax credit technician registration, among other changes. The Department of Energy proposed to amend Or. Admin. R. 330.135, pertaining to the public building green energy technology program. Changes implement new state laws adding geothermal electricity generation or the direct use of geothermal energy to the list of eligible green energy technologies.

The Department of Energy proposed to amend Or. Admin. R. 330.110, Small Scale Local Energy Loan Program. Changes revise rule definitions to clarify terms and align the regulations with current practices. There will be a public hearing November 29, 2012. Tennessee: Clean Air Act (CAA)

The Environment and Conservation Agency amended Tenn. Admin. Code §1200.03.10, Required Sampling, Recording, and Reporting. Changes allow facilities subject to Title V to sumit reports on data from continuous in-stack monitoring systems semi-annually rather than quarterly. Changes take effect February 5, 2013. Virginia: Water

The Department of Environmental Quality proposed to amend 9 Va. Admin. Code §25.193, General Virginia Pollutant Discharge Elimination System Permit for Concrete Products Facilities. The rulemaking would reissue the general permit that expires on September 30, 2013. There will be a public hearing December 5, 2012, and the deadline for comment is January 13, 2013. Washington: Air

The Department of Ecology proposed to amend Wash. Admin. Code §197.11, pertaining to the State Environmental Policy Act. Changes would establish separate flexible exemption thresholds for local governments and clarify language related to "residential," "parking lot" and "landfill and excavation" categories of minor new construction. There will be a public hearing December 4, 2012, and the deadline for written comment is December 11.
