Iowa: Agriculture

The Soil Conservation Division amended Iowa Admin. Code Ch. 10, Iowa Financial Incentive Program for Soil Erosion Control. The amendments adopt statutory changes to alter the time period for determining if the land has been plowed or used for row crops to "the prior fifteen years," rather than 1966 to 1981. Vermont: Waste

The Waste Management Division proposed to amend the Hazardous Waste Management Regulations to incorporate changes to federal requirements and to improve implementation of the rule. Vermont: Clean Air Act (CAA)

The Air Pollution Control Division proposed to amend its Low Emission Vehicle Rules to incorporate changes to California's program. The deadline for comment is October 1, 2012. See http://www.anr.state.vt.us/air/htm/ProposedAmendments.htm#LEV3.

Utah: Energy

The Department of Environmental Quality proposed to amend Utah Admin. Code r. 649.3.39, Hydraulic Fracturing. Amendments would require an oil and gas well operator to disclose the amount and type of chemicals used in hydraulic fracturing and would address well bore integrity and water flowback management requirements. At least 56 percent of completed wells are already reported to the FracFocus website under voluntary compliance, but the requirements will mandate the reporting of all wells. There will be a public hearing September 26, 2012, and the deadline for comment is October 15.

Oklahoma: Waste

The Department of Environmental Quality proposed to amend Okla. Admin. Code §252.205.3.1, Incorporation by Reference. Changes would incorporate federal hazardous waste regulations. Oklahoma: Clean Air Act (CAA)

The Department of Environmental Quality proposed to amend Okla. Admin. Code §252.100. Changes would clarify requirements for open burning and incorporate recent changes to EPA regulations. Missouri: Clean Water Act (CWA)

The Department of Natural Resources rescinded Mo. Code Regs. Ann. §20.6.100, General Pretreatment Regulation, and replaced it with a new section to incorporate changes to federal regulations. Michigan: Pollution Prevention

The Department of Environmental Quality proposed to amend Mich. Admin. Code R. 324, pertaining to the Small Business Pollution Prevention Assistance Loan Fund. Changes will incorporate legislative amendments and clarify rules for participation. There will be a public hearing November 5, 2012, and the deadline for comment is November 7. California: Climate Change

The Air Resources Board proposed to amend Cal. Code Regs. tit. 13 §§1900, 1956.8, 1960.1, 1961, 1962.1, & 1976, pertaining to the Low Emission Vehicle and Zero Emission Vehicle regulations. Changes would alter standards for model years 2017-2025 to allow compliance with federal greenhouse gas standards. There will be a public hearing November 15, 2012. Iowa: Clean Air Act (CAA)

The Environmental Protection Commission amended Iowa Admin. Code Ch. 23, Emission Standards for Contaminants. Changes  adopt federal standards and make it clear that the commission is not adopting standards that U.S. EPA is reconsidering. Amendments take effect October 24, 2012.
