Virginia: Waste

The Department of Environmental Quality amended 9 Va. Admin. Code §90.130, Solid Waste Planning and Recycling Regulations. Amendments modify the frequency for recycling data submittal to once every four years for municipalities of 10,000 people or less. Changes take effect August 15, 2012. Virginia: Waste

The Department of Environmental Quality amended 9 Va. Admin. Code §20.90, Solid Waste Management Permit Action Fees and Annual Fees. Amendments remove the cap on total solid waste management fees in accordance the 2012 Appropriations Act. Amendments take effect August 15, 2012. Virginia: Clean Air Act (CAA)

The Department of Environmental Quality amended 9 Va. Admin. Code §5.151, Regulation for Transportation Conformity. Changes ensure conformity between state regulations and recently promulgated EPA rules. Amendments take effect August 15, 2012. Virginia: Quality

The Soil and Water Conservation Board proposed to amend 4 Va. Admin. Code §50.70, Resource Management. The regulation implements a process by which farmers can adopt voluntary best management practices to improve state water quality and thereby be certified as compliant with TMDL and nutrient requirements for nine years. The rule would also implement EPA's Watershed Implementation Plan requirements. There will be public hearings August 13, 14, &15, 2012, and the deadline for comment is September 14.

Washington: Toxic Substances

The Department of Ecology proposed to adopt Wash. Admin. Code §173.910, Mercury-containing lights product stewardship program. The rule would clarify requirements for producers of mercury-containing lights, including their recycling responsibilities and how producers will fund the Department's costs related to the program. Ohio: Quality

The Environmental Protection Agency proposed to amend Ohio Admin. Code §3745.5, pertaining to the water quality trading program. Changes relate to a five-year review. There will be a public hearing August 21, 2012. See http://wwwapp.epa.ohio.gov/legal/pubnots/120720.pdf.

Montana: Water

The Department of Natural Resources and conservation proposed to amend Mont. Admin. R. 36.12, pertaining to water right permitting. Changes will raise fees and streamline the permitting process, in addition to encouraging permit seekers to meet with the Department prior to submitting an application. Maine: Land Use

The Land Use Regulation Commission amended 06-096 Code Me. Regs. Ch. 10, Land Use Districts and Standards. Changes alter rules for small projects by allowing the construction of accessory structures smaller than 750 square feet in certain subdistricts without a permit. Maine: Ground water

The Department of Environmental Protection proposed to amend 06-096 Code Me. Regs. Ch. 692, Siting of Oil Storage Facilities. The amendments specify when a diesel fuel supply tank for refueling heavy equipment in a borrow pit may be installed in an area that is mapped as a “significant sand and gravel aquifer” by the Maine Geological Survey. Georgia: Clean Air Act (CAA)

The Environmental Protection Division proposed to amend Chapter 391.3.1.02, pertaining to rules for air quality control. Changes are needed to bring the section into compliance with the CAA.
