Coleman v. Conservation Society of Southern Vermont

After granting a writ of certiorari, the Supreme Court vacates the second circuit's judgment in Conservation Society of Southern Vermont v. Secretary of Transportation, 5 ELR 20068, and remands the case for further consideration in light of the recent amendment to NEPA regarding EIS preparation by state agencies (ELR 41014), and the Court's recent ruling in Aberdeen & Rockfish R.R. Co. v. SCRAP (SCRAP II), 5 ELR 20418.

Per curiam

The petition for a writ of certiorari is granted. The judgment is vacated and the case is remanded to the United States Court of Appeals for the Second Circuit for further consideration in light of Pub. L. 94-83 and Aberdeen & Rockfish R.R. v. SCRAP, 422 U.S. (1975).
