Hornbeck Offshore Servs. v. Salazar

The Fifth Circuit refused to reinstate the six-month moratorium on deepwater drilling in the Gulf of Mexico. In June, a district court granted an offshore service company's motion to enjoin the moratorium. The DOI sought a stay of that injunction, but it failed to demonstrate a likelihood of irreparable injury if the stay is not granted. It made no showing that there is any likelihood that drilling activities will be resumed pending appeal. The DOI may apply for emergency relief if it can show that drilling activity by deepwater rigs has commenced or is about to commence.
