Sunnen Prods. Co. v. Chemtech Indus.

Citation: 17 ELR 20884
No. No. 86-0457C(6), 658 F. Supp. 276/25 ERC 2142/(E.D. Mo., 04/24/1987)

The court holds that the seller of property on which it operated a chemical manufacturing plant from which hazardous substances were released is liable to the buyer for response costs under § 107(a)(2) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). In a footnote, the court observes that while certain equitable defenses are available in a CERCLA action, the defense of caveat emptor is not available.
