United States v. Hancock County

Citation: 12 ELR 20852
No. No. CIV-2-81-55, 536 F. Supp. 17/(E.D. Tenn., 04/15/1981)

The district court denies defendant's motion for summary judgment in an action alleging discharges of a pollutant in violation of § 301(a) of the Federal Water Pollution Control Act. The defendant is to be judged under a standard of strict liability. Its allegation that its discharges were made pursuant to a contract fail to demonstrate that there is no genuine issue of material fact or that the complaint has no legal basis.
