Barry v. Grela

Citation: 7 ELR 20698
361 N.E.2d 1251/372 Mass. 278, (Mass., 03/31/1977)

The court affirms a lower court ruling granting to plaintiff the right to walk on defendants' land, between high and low water marks, in order to fish from a publicly owned jetty. The court finds that the access right stems from a colonial Massachusetts ordinance which granted ownership subject to a reserved easement for "free fishing and fowling."
