Baton Rouge, City of v. EPA

Citation: 10 ELR 20546
No. No. 78-2719, 620 F.2d 478/14 ERC 1752/(5th Cir., 06/30/1980)

The court dismisses a petition for review of an Environmental Protection Agency (EPA) order requiring petitioner to submit to the Agency a program for improving the performance of its sewage treatment plant. Under § 509(b) of the Federal Water Pollution Control Act, the courts of appeals have jurisdiction to review only a narrowly defined class of EPA actions. Because § 309 compliance orders are not specifically made reviewable, the court lacks jurisdiction over the case and the petition is therefore dismissed.
