Tribal Village of Akutan v. Hodel

Citation: 19 ELR 20077
No. Nos. 88-3610 et al., 859 F.2d 662/(9th Cir., 06/27/1988) Order staying injunction

The court stays a district court injunction against an outer continental shelf lease sale in Bristol Bay. The court holds that appellees have met the standard for a stay, which is the same as that for a preliminary injunction. The court has ruled for appellees on the merits. The balance of hardships also favors appellees. Leaving the injunction in effect would delay exploration for a year, at appellees' cost, while staying it would not harm appellants or the environment and would provide further information for evaluating the risks of the next stage of development. The public interest in developing oil and gas reserves also favors lifting the injunction.

[The court's decision on the merits is published at 19 ELR 20071. Related opinions are published at 16 ELR 20245, 20740.]
