George's Pest Control v. EPA

Citation: 8 ELR 20063
No. No. 76-3760, 572 F.2d 204/11 ERC 1159/(9th Cir., 11/21/1977)

Upon direct review, the Ninth Circuit upholds a finding by the Environmental Protection Agency Regional Administrator that defendant had applied a pesticide in a manner inconsistent with the label instructions in violation of the Federal Insecticide, Fungicide and Rodenticide Act. The record contained substantial evidence supporting that finding and the assessment of a civil penalty of $1,000 is therefore affirmed.
