Manchester Envtl. Coalition v. EPA

The court vacates and remands the Environmental Protection Agency's (EPA's) approval of the State of Connecticut's application to revise its air quality implementation plan by revoking its indirect source review program. EPA erroneously construed § 110(a)(5)(A)(iii) of the Clean Air Act as requiring it to approve the state's request without considering whether such revocation would render the state implementation plan (SIP) inadequate to attain and maintain national ambient air quality standards. The plain meaning of the statutory proviso that the revised plan must meet "the requirements of this section" includes both the procedural and substantive requirements of § 110 rather than simply the former. None of the Agency's arguments of policy, legislative intent, intra-statutory conflict, or practical inequities is sufficiently persuasive to overcome the clear import of this statutory language. The court, however, rejects petitioner's further contention that an SIP is statutorily required to contain an indirect source review program and an intervenor's argument that state revocation of such a program is a self-executing revision of its SIP which does not require EPA approval.Finally, the court grants petitioner's request for an award of attorney fees.
