An administrative law judge (ALJ) held that it was premature to grant a company's motion for partial accelerated decision on its inability to pay prior to a finding of liability on the merits. The U.S. Environmental Protection Agency sought a proposed penalty of $330,462 against the company for alleged Resources Conservation and Recovery Act violations involving tank systems used to store hazardous waste.
