Goodman Oil Co.
An administrative law judge (ALJ) denies a company's motion to reopen a hearing to introduce into the record additional documents concerning the underground storage tanks (USTs) at five of its service stations, and to present further testimony concerning three of the four USTs at one of its bulk plant. At the prior hearing the company was found liable for its failure to conduct inventory control for USTs containing petroleum at several of its gasoline service stations. The company was also assessed a civil penalty. The ALJ denies the company's motion. The company has not shown that the proposed evidence is new, that the proposed testimony is not cumulative, and that it had good cause for not adducing the proposed testimony and evidence at the hearing.
